The Austrian Cartel Court has found that at least 40 construction companies across Austria participated in a cartel between 2003 and 2017.
Thus, there is a legal presumption that the public-sector customers have suffered damage. The construction companies involved in the cartel are liable for this damage. A foundation has already been set up in the Netherlands to find a fair compromise between the aggrieved contracting authorities and the construction companies.
